1. Agreement to Terms
By accessing or using NaviGuide ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
NaviGuide is a platform that provides AI-powered personality quizzes and generates personalized guides to help users understand themselves and improve their relationships with others. The Service includes:
• Personality and work-style quizzes
• AI-generated personal guides ("Self Guides")
• AI-generated guides for others ("User Guides")
• Team collaboration features
• Profile sharing capabilities
3. Account Registration
To use certain features of the Service, you must register for an account. When you register, you agree to:
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
You must be at least 16 years old to create an account and use the Service.
4. Subscriptions and Payments
4.1 Subscription Plans
The Service offers both free and paid subscription plans. Paid plans provide additional features and usage limits as described on our pricing page.
4.2 Billing
For paid subscriptions, you agree to pay all fees associated with your chosen plan. Payments are processed through Stripe and are billed in advance on a monthly or annual basis.
4.3 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.
4.4 Refunds
Refunds are handled on a case-by-case basis. Please contact us at support@naviguide.ai for refund requests.
5. User Content
5.1 Your Content
You retain ownership of any content you submit to the Service, including quiz responses, profile information, and any other materials ("User Content").
5.2 License to Us
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display your content solely for the purpose of providing and improving the Service.
5.3 Content Restrictions
You agree not to submit content that:
• Is false, misleading, or fraudulent
• Is defamatory, obscene, or offensive
• Infringes on intellectual property rights
• Violates any applicable laws or regulations
• Contains malware or harmful code
6. AI-Generated Content
The guides and insights generated by our AI are provided for informational and self-improvement purposes only. You acknowledge that:
• AI-generated content is based on your quiz responses and may not be completely accurate
• The content does not constitute professional advice (psychological, medical, or otherwise)
• You should not rely solely on AI-generated content for important decisions
• We are not responsible for any actions you take based on AI-generated content
7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by NaviGuide and are protected by international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.
8. Prohibited Activities
You agree not to:
• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems or bots to access the Service
• Impersonate another person or entity
• Harvest or collect user information without consent
• Circumvent any usage limits or restrictions
• Use the Service to send spam or unsolicited messages
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so through your account settings or by contacting us.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED CONTENT OR INSIGHTS PROVIDED THROUGH THE SERVICE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAVIGUIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless NaviGuide and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
15. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after changes constitutes acceptance of the new Terms.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
